1.1 Legal Compliance

The following activities are expressly prohibited:

• Using our services for any unlawful purpose or in violation of these terms
• Impersonating any person or entity or misrepresenting your affiliation
• Interfering with or disrupting the operation of our website or servers
• Attempting to gain unauthorized access to our systems or user accounts
• Uploading viruses, malware, or other harmful code
• Harvesting or collecting information about other users without consent
• Engaging in fraudulent activities or providing false information

1.3 Content Guidelines

You agree to indemnify, defend, and hold harmless Amoy Infusion, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from your use of our services, your violation of these terms, or your violation of any rights of another party.

You are responsible for:

• Ensuring all information you provide is accurate, current, and complete
• Updating your information promptly when changes occur
• Maintaining the confidentiality of any account credentials
• Notifying us immediately of any unauthorized use of your account

2.3 Privacy Obligations

You acknowledge that you have read and understood our Privacy Policy, which explains how we collect, use, and protect your personal data. You consent to the collection and use of your information as described in the Privacy Policy and agree to comply with all applicable data protection laws when interacting with our services.

2.4 Third-Party Interactions

Your interactions with third parties through our services, including tea suppliers, certification bodies, or other service providers, are solely between you and such third parties. We are not responsible for the actions, products, services, or content of third parties, and you release us from any claims arising from your interactions with third parties.

3.1 No Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties of uninterrupted or error-free service
• Warranties that defects will be corrected

3.2 Limitation of Liability

To the maximum extent permitted by law, Amoy Infusion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Business interruption or downtime
• Cost of substitute goods or services
• Personal injury or property damage

Our total liability arising from or related to these terms or your use of our services shall not exceed the amount you paid to us in the twelve months preceding the event giving rise to liability, or SGD 100, whichever is greater.

3.3 Exclusion of Consequential Damages

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law. Nothing in these terms shall exclude or limit our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

3.4 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor disputes, government actions, telecommunications failures, or interruptions in third-party services.

4.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore, without giving effect to any principles of conflicts of law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

4.2 Jurisdiction

You irrevocably submit to the exclusive jurisdiction of the courts of Singapore for the resolution of any disputes arising out of or relating to these terms or your use of our services. You waive any objection to venue in Singapore and any claim that Singapore is an inconvenient forum.

4.3 Dispute Resolution

Before initiating any formal legal proceedings, we encourage parties to attempt resolution through good faith negotiation. The dispute resolution process shall proceed as follows:

• Written notification of the dispute to the other party with details of the claim
• A period of 30 days for informal negotiation and resolution attempts
• Mediation through a mutually agreed mediator if negotiation is unsuccessful
• Arbitration or court proceedings as a last resort

4.4 Class Action Waiver

To the extent permitted by law, you agree that any dispute shall be brought in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general action. This waiver applies to class arbitration as well.

5.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Cookie Policy, and any other legal notices published on our website, constitute the entire agreement between you and Amoy Infusion regarding your use of our services and supersede all prior agreements and understandings.

5.2 Severability

If any provision of these terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.

5.3 Waiver

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Amoy Infusion.

5.4 Assignment

You may not assign, transfer, or delegate these terms or your rights and obligations hereunder without our prior written consent. We may freely assign these terms and our rights and obligations to any party without restriction. Any attempted assignment in violation of this provision shall be null and void.

5.5 Survival

Provisions that by their nature should survive termination of these terms shall survive, including but not limited to provisions relating to intellectual property, disclaimers, indemnification, limitations of liability, and dispute resolution.
